Bill
Cosby is facing being forced to testify under oath over allegations he sexually
assaulted a woman inside the statute of limitations.
The
shamed comic has been labeled a ‘serial rapist’ in a damaging lawsuit filed by a
model who claims the star drugged and sexually assaulted her at a Playboy
mansion party in 2008.
Chloe
Goins says she was just 18 when the aged comedian spiked her drink with a
sedative and lured her into a bedroom before launching a chilling sexual attack
on her at one of Hugh Hefner’s parties.
LAPD
has just completed its investigation into the alleged assault, which is within
the statute of limitations, the Daily Mail Online has learned.
Detectives
passed their findings to the US Attorney’s Office for central California just
days ago, which will decide whether or not to press criminal charges.
Now
Goins, 24, has filed a civil lawsuit against the Cosby Show star, 78, saying
she wants ‘the truth to come out’.
The
move will allow her lawyers to force him to answer questions under oath for the
first time about an allegation which is inside the time period of statutes of
limitation.
The
lawsuit, to be filed on Tuesday in the United States District Court Central
District of California, Los Angeles, describes how Goins immediately felt ‘sick
to her stomach and dizzy’ after drinking an alcoholic beverage brought to her
by Cosby at the party.
It
seeks $75,000 damages which lawyers say is not an actual sum but a technical
measure to allow the case to be filed.
‘It
is Ms Goins belief that Mr Cosby had put some type of drug or narcotic in the
drink without her knowledge,’ the suit says.
The
court document goes on to detail how Cosby then took unwell Goins to a bedroom
in the playboy mansion where she ‘blacked out’.
‘Ms
Goins awoke sometime later,’ the court papers state.
‘When
she awoke, she was laying on her back on a bed and she was naked. Her clothes
had been removed, without her consent.
‘Ms
Goins awoke to find that her breasts were wet and sticky, as if someone had
been licking them, and Mr Cosby was biting on one of her toes as he crouched at
the end of the bed.’
After
waking up Goins asked Cosby what he was doing and he immediately left, the
lawsuit continues.
The
incident left her feeling ‘scared, afraid, embarrassed and repulsed at what had
just occurred’, it added.
The
15-page document goes on to state that Cosby ‘clearly intended to cause
offensive contact with Ms Goins breasts and otherwise naked body, and did in
fact cause contact with these parts of her body. ‘Mr Cosby also caused Ms Goins
to have imminent fear of additional offensive contact with her groin.’
The
lawsuit lists 40 other ‘victims’ of the veteran TV personality – once known as
'America’s favorite dad' - and details how Cosby allegedly drugged and sexually
assaulted them over a period spanning 40 years.
The
ten-page-long list includes Andrea Constand, who filed a civil sexual assault
lawsuit against Cosby in 2005 before settling for an undisclosed amount, and
supermodel Janice Dickinson, who claims Cosby drugged and sexually attacked her
in 1982.
The
lawsuit states that the list ‘shows he [Cosby] has a habit, practice and/or
modus operendi of drugging and sexually assaulting women without their
consent.'
The
suit even goes so far to label the stand-up comedian a ‘serial rapist,’ adding,
‘The nature of these activities establishes a history of a serial rapist that
has been conducting these horrendous activities against women for over the last
40 years.’
Goins
is suing Cosby for an unspecified amount claiming the alleged attack left her
suffering from ‘emotional distress, psychological and psychiatric trauma,
mental anguish, humiliation, confusion, embarrassment, loss of self-esteem,
loss of dignity’, and also caused her to miss out on a ‘proper and complete
education’.
However
Goins’s lawyer Spencer Kuvin said his client’s number one priority was that the
truth comes out and Cosby is prosecuted for his actions.
Kuvin,
who represented victims of notorious billionaire pedophile Jeffrey Epstein,
said, ‘We wanted to make sure that the police had enough to time to do a full
investigation so we waited until the police completed their entire
investigation.
‘They’ve
now done that - they notified us two days ago. The investigation is now
complete and has been turned over to the States attorney’s office to determine
whether charges should be filed.
‘Chloe
is ready and available to speak with the States attorney if they need any
additional information but on behalf of her individually I have to protect her
claim by filing this lawsuit in civil court to make sure that the statute of
limitations is preserved and that her claim is preserved.
‘Her
first and primary issue is the prosecution of Cosby. And if in fact the states
attorney decides to charge him then we will wait to pursue this civil action. I
need to protect her interests while that’s pending.’
Kuvin
insisted that money was not his client’s primary motive.
He
added, ‘We filed for an amount in excess of $75,000 but the only reason that
number is in there is because we need to reach the jurisdictional limit of the
court.
‘Chloe’s
primary interest now and has always been is getting to the truth and making
sure that everyone that is involved is under oath and deposed.
‘At
the end of the day civil litigation can only bring money. We can’t put people
in jail, we can’t make things completely better.
‘Sometimes
money justice is the only thing that you can get but right now what Chloe wants
is for people to be under oath and deposition - like Mr Cosby and Mr Hefner and
all of the other people involved - so we can get to the truth and make sure the
public knows the truth.
‘She’s
been called all kinds of names - along with the other women - and now it’s time
for the truth to come out at long last.’
In
an exclusive with Daily Mail Online last year, Goins talked about how she
wanted to obtain justice for all Cosby’s alleged victims, who cannot prosecute
Cosby themselves as the statute of limitations has passed.
'This
isn't something I really wanted out there about myself, but I saw all the women
who had come forward, over 20 women and it grossed me out,’ she said.
‘I
feel he needs to pay for it, he deserves to pay for it.’
Cosby
has always denied all wrongdoing and has never been charged with any
crime.
